The Safety Audit Trail: Why Brokers and Providers Must Demonstrate Safety Together

In May 2026, the U.S. Supreme Court decided that freight brokers can be considered negligent and held liable if they select an unsafe transport company. In Montgomery v. Caribe Transport II, a trucking broker was sued after it was discovered that a carrier company the broker selected had only a conditional federal safety rating and also had a history of driver, maintenance, and hours-of-service violations. The Court ultimately ruled that states can obligate brokers to use reasonable standards to choose carrier companies that ensure the safety of the carrier’s vehicles on the road. Federal law, the Court also concluded, does not shield brokers from that responsibility.

Although this decision applies to freight trucking, there are obvious parallels to how NEMT brokers and transportation providers (TPs) interact. NEMT brokers also select TPs on behalf of someone else, such as a state Medicaid program, and cannot always verify how safely those providers operate on a daily basis. If courts or state Medicaid programs start applying similar logic to NEMT, brokers will need more than just a provider’s word that its vehicles and drivers are safe.

They will need proof.

Brokers and TPs, however, should try not to see this as a new burden. Instead, this possible trend could be an opportunity to increase the reputations of both parties and improve passenger safety greatly. Transportation providers who can prove they use safety-conscious procedures, implemented through technology and automation when possible, become the obvious choice for broker contracts. Brokers can then point to such verified, documented safety practices to protect themselves and their passengers and foster trust in state Medicaid programs. Both sides benefit from implementing what we call a safety audit trail: a verifiable chain of safety practices that underpins every trip from initial vehicle inspection to passenger drop-off. This article discusses some of the practices that make up that chain, and how TPs and brokers can work together to decide on the most effective ways to implement them.

Pre-Trip Vehicle Condition

A safety audit trail starts even before the vehicle begins its day. Interior and exterior photos submitted by drivers each morning and saved to a central repository are a good start. Although they capture the vehicle’s superficial condition, providers should go further to prove the vehicle is actually safe. A complete pre-trip record might also include a checklist that captures tire inflation and engine fluid levels along with the proper functioning of lights, wipers, and mirrors. Fleets containing wheelchair-accessible vehicles have additional requirements: federal standards require an interlock that keeps the vehicle from moving while a wheelchair lift is deployed. Not only can the interlock’s state be an active check that prevents vehicle movement, but it can also be captured as part of the trip’s official record in the software platform you use.

Active Telematics: Real-Time Safety Enforcement

OBD data only matters if it changes what happens during the trip. Active telematics means the vehicle responds to safety information in real time rather than afterward. Seatbelt sensors are the most obvious case. Fleets using in-cab alerts can inform a driver the instant a passenger’s belt (or the driver’s belt) is unfastened, instead of discovering the issue after the ride ends. Independent research from the Insurance Institute for Highway Safety found that a continuous audible reminder raises seatbelt use by about 30 percent compared with a brief, one-time chime. The same live-response model can be extended to other sensors already common in fleet telematics, including distraction detection that flags a driver looking away from the road or door-status sensors that verify the passenger compartment is secured before movement begins.

Analytic Telematics: Converting Data Into Improvement

Not all OBD data needs to be part of active safety detection. When the same data is aggregated over time, it reveals safety-relevant patterns that do not require an instant alert. Harsh braking and rapid acceleration events, tracked over time, may indicate a driver who needs coaching, or a vehicle whose brakes or suspension need service before a mechanical problem turns into a safety incident. Your fleet platform should let you access this data so you can spot trends related to both driver improvement and preventive maintenance needs that otherwise might only reveal themselves during a later scheduled inspection.

AI Camera Systems: Monitoring the Entire Cabin

Most in-vehicle camera systems are designed to assess driver behavior: following distance, lane position, and signs of distraction or fatigue. That is important, but it covers only part of what occurs inside the vehicle. A passenger-facing camera adds another layer of protection, one built specifically for NEMT’s population. Elderly passengers, medically fragile passengers, or people with cognitive or mobility impairments may have a distress event or other medical episode during the trip, and they may not be able to notify the driver on their own. An AI-powered camera system that observes the passenger compartment, not just the driver, gives providers a way to detect and document those events as they unfold.

Specialty Vehicle Integration: Securement That Polices Itself

Vehicles designed for wheelchairs and stretchers already depend on hardware produced by specialty manufacturers. This can include four-point tie-down systems, WC19-certified securement points, and lift interlocks that satisfy federal motor vehicle safety standards. That hardware could be extended further into a fleet’s active safety stack. A securement point that reports its own connection status, much like a seatbelt sensor reports whether it is latched, would allow a fleet to verify and document that a wheelchair or stretcher was actually secured before the vehicle moved, not merely that a driver was trained to check it. This is a newer integration area between vehicle upfitters and fleet software, so it should be treated as a partnership opportunity rather than an established standard.

Driver Technology: Eliminating Distraction at the Source

Many providers already give drivers a mobile device for navigation, dispatch, and messaging. That same device can be configured, through mobile device management tools already common in commercial fleet deployments, to block access to social media and messaging apps whenever the vehicle is moving. Combined with the driver-facing cameras already used for trip updates and incident reporting, this closes an obvious gap where a device intended to support the trip should not also become a distraction during it.

Extending the Chain to Non-OEM Equipment

Many fleets install safety equipment beyond what comes standard on the vehicle, including aftermarket tire pressure monitoring systems. These systems provide useful alerts on their own, but they often remain outside the fleet’s primary monitoring platform. TPs should explore whether the products aftermarket manufacturers sell can be technologically integrated into alert workflows the same way that OEM sensors can. This closes another important gap where a fleet should not need to consult three separate dashboards to determine (and record for possible future safety audits) whether a vehicle is ready for a trip.

Building the Chain Together

No single practice stands alone, and none by itself creates a complete safety audit trail. Pre-trip inspections verify that the vehicle is safe to depart the lot. Active telematics verifies that the driver and passengers remained protected during the trip. Analytic telematics shows that the fleet is improving over time rather than simply reacting to incidents. Camera systems and specialty vehicle data verify what occurred when something went wrong.

Taken together, they give TPs a documented chain of evidence, and not just a pledge, they can use to justify their reputation and preferred status. When brokers see extensive safety checkpoints implemented with this level of thoroughness and care, their trust is based on documented proof and not just faith. If NEMT liability moves in the direction the Supreme Court has charted for trucking, providers and brokers who have already analyzed and assembled this chain will be prepared. Those who have not will be putting it together under pressure and after the fact, at a time when it matters most.
